Terms & Conditions

This is a public online space.  Important note about privacy and moderation of posts.

As part of the Mount to Arataki Spatial Plan project, Tauranga City Council is seeking to engage with our community to create a shared vision for the subject areas and get feedback on a draft plan and ideas on ways to support the wellbeing and liveability of visitors and residents now and in the future.

This site allows you to provide your feedback on the project and see and comment on the feedback of others to provide an online discussion in a similar way to what would be achieved through our face-to-face community engagement sessions. 

This site is a public online space.  All content you post on the map is viewable by the public. The feedback you share by filling in the survey on the left column will not be made public on this site. 

We have rules about behaviour that will be considered unacceptable and these are specified in our Moderation Policy below.  Our consultant, Beca Limited (who is managing this site on our behalf), monitors and moderates all posts and if they contain information that breaches these rules, they may be removed from public view.  If you see a post that you think should be removed from this site, please read our Notice and Takedown Procedure below for who to contact and the information you will need to provide. 

We do not request or collect any personal information about you on this site.  Your posts are anonymous.  Please do not include any information that identifies you or others in your posts.  Posts that contain personal information about identifiable individuals will be considered a breach of the rules in our Moderation Policy and may be removed from public view and permanently deleted.  We ask you to provide your demographic information and the suburb you live in anonymously so we can see if we have engaged with a wide cross section of our community.  Providing your demographic and suburb information is optional and it will not be made public on this site.  The demographic and suburb information collected will be published in aggregated form when the results of this consultation are reported to Council.  For information about our obligations and your rights under the Privacy Act 2020, please refer to Tauranga City Council’s privacy statement. 

 

MODERATION POLICY

This is a community space and Tauranga City Council has rules about behaviour that will be considered unacceptable. 

Our consultant, Beca Limited (who is managing this site our behalf), monitors and moderates comments and conversations posted on this site and if they breach our rules, they may be removed from public view.  Content on this site is also subject to our Notice and Takedown Procedure.

The Rules

  1. You must not publish or post any information that identifies you or other people, including Tauranga City Council staff or the staff of our contractors or consultants (including, without limitation, Beca Limited).  We do not want any personal information about you or other people posted on this site as all posts are publicly viewable. 
  2. You must not make defamatory statements about another person.
  3. You must not impersonate individuals, groups, or organisations in a manner that is intended to or does mislead, confuse or deceive others.
  4. You must not attempt to advertise, sell or facilitate the sale of any goods or services (whether they are legal or illegal goods or services, and whether they are for sale by you or a third-party).
  5. You must not post anything that is in furtherance of illegal activities, or that promotes or incites illegal activities.
  6. You must not breach any other person’s intellectual property rights (including copyright and trademark).
  7. You must not post anything that contains sensitive, objectionable, obscene, offensive or disturbing material, or that could be considered “harmful” under the Harmful Digital Communications Act 2015.  This includes (without limitation) the following:
    1. You must not post offensive or threatening language or remarks, including swear words or words in breach of legislation.
    2. You must not post sensitive media, including media that depicts gore, graphic violence, adult content, nudity, sexual violence and/or assault.
    3. You must not threaten to expose a person’s personal information or incentive others to do so.
    4. You must not threaten violence against an individual or a group of people. 
    5. You must not threaten or promote terrorism or violent extremism.
    6. You must not engage in the targeted harassment of someone, or incite other people to do so.  This includes wishing or hoping that someone experiences physical harm.
    7. You must not promote violence against, threaten, or harass other people on the basis of race, ethnicity, national origin, caste, sexual orientation, gender, gender identity, religious affiliation, age, disability, or serious disease. 
    8. You must not encourage suicide or self-harm.

Please note:  We may change this Moderation Policy at any time by updating it on this site.  This Policy was last updated on 15 June 2023.

 

NOTICE AND TAKEDOWN PROCEDURE

Introduction

In using this site to seek community feedback, Tauranga City Council and our consultant, Beca Limited (“Beca”) (who is managing this site on our behalf), acts in good faith.  We ask those who post comments and conversations to comply with the rules in our Moderation Policy.  Beca monitors and moderates content posted on this site and if it breaches our rules, it may be removed from public view. 

However, despite these safeguards, we recognise that from time to time material published online may be in breach of copyright laws, contain sensitive personal information, or contain content that may be regarded as sensitive, objectionable, obscene, offensive, disturbing or defamatory, or that could be considered harmful under the Harmful Digital Communications Act 2015.  

Notice

  1. Please notify Beca in writing if you have found material on this site that you are concerned contains:
    1. content that breaches your copyright (or the copyright of a person for whom you are the authorised representative) and that is not covered by a limitation or exception;
    2. your personal information for which you have not given permission, or that otherwise contravenes privacy laws; or
    3. content that you consider sensitive, objectionable, obscene, offensive, disturbing or defamatory, or that could be considered harmful under the Harmful Digital Communications Act 2015.
  2. Send your notification to Beca by:


    1. email to [email address to be inserted].
  3. Your notification must specify the following:
    1. Your contact details.
    2. The full details of the material.
    3. The exact and full url where you found the material.
    4. If the request relates to copyright, provide proof that you are the rights holder and a statement that, under penalty of perjury, you are the rights holder or are an authorised representative.
    5. The reason for your request including, but not limited to, those detailed in paragraph 1 above.

Takedown

Upon receipt of notification, this ‘Notice and Takedown’ procedure is then invoked as follows:

  1. Beca will acknowledge receipt of your complaint by email and will assess the validity and plausibility of the complaint.
  2. Upon receipt of a valid and plausible complaint, the material will be removed from public view on the site.
